1. About this Privacy Policy

1.1 This Privacy Policy applies to the website located at concretinggeelongvic.com (the "Website"). The Website is owned and operated by Justin Speranza (ABN 78 615 950 501), sole trader ("we", "us", "our"). Contact details are set out in clause 20.

1.2 This Privacy Policy explains how we collect, hold, use, and disclose Personal Information, and how you may access and correct that information or make a privacy complaint. It is drafted to comply with the Privacy Act 1988 (Cth) (the "Privacy Act"), including the Australian Privacy Principles ("APPs"), and forms part of, and should be read together with, our Terms of Service.

1.3 Because the Website operates as a lead-generation and referral platform and we receive a commercial benefit for disclosing Enquiry information to Providers, we treat ourselves as bound by the Privacy Act and the APPs in full, and this Policy is prepared on that basis.

1.4 Capitalised terms not defined in this Policy have the meaning given in the Terms of Service. In particular:

  • "Enquiry" means any request for a quote, call, message, or other communication submitted through or via the Website, including through any form, telephone number, live chat, or email address displayed on it;

  • "Personal Information" has the meaning given in the Privacy Act — broadly, information or an opinion about an identified individual, or an individual who is reasonably identifiable;

  • "Providers" means the independent third-party concreting businesses or providers to whom an Enquiry is or may be referred;

  • "Referral Service" means the receipt of an Enquiry and its transmission to one or more Providers.

1.5 By using the Website or submitting an Enquiry, you consent to the collection, holding, use, and disclosure of your Personal Information in accordance with this Policy. If you do not agree, please do not use the Website or submit an Enquiry.

2. The most important thing to understand — we refer your details to third-party businesses

2.1 The core function of the Website is to pass your Enquiry — including your Personal Information — to one or more independent concreting businesses (Providers), who will then contact you directly. We receive a fee or other commercial benefit from Providers for doing so.

2.2 By submitting an Enquiry you expressly consent to us disclosing the Personal Information contained in your Enquiry to one or more Providers by SMS, email, telephone, or other electronic means, for the purpose of those Providers contacting you about your concreting project and providing quotes or services.

2.3 Once your Personal Information has been disclosed to a Provider, that Provider handles it under its own privacy practices and its own legal obligations. We do not control, and are not responsible for, a Provider's storage, use, or further disclosure of your Personal Information after it has been transmitted. You should direct any privacy queries concerning a Provider's handling of your information to that Provider.

3. Kinds of Personal Information we collect

3.1 The kinds of Personal Information we collect and hold depend on how you interact with the Website, and may include:

(a) Identity and contact information — your name, telephone number(s), email address, suburb, postcode, and property or project address;

(b) Enquiry and project information — details you provide about your concreting project, such as the type of work sought (e.g. driveway, slab, exposed aggregate), approximate dimensions or area, site conditions, budget indications, preferred timing, and any free-text message you include;

(c) Communications information — the content of emails, SMS messages, web form submissions, live chat sessions, and telephone calls between you and us, including call recordings and call metadata (such as time, duration, and the number called from) where calls are routed through call-tracking services (see clause 7);

(d) Technical and usage information — your IP address, approximate geolocation derived from IP, device type, operating system, browser type and version, referring URLs and search terms (including which advertisement you clicked), pages viewed, time and date of visits, and interactions with the Website, collected via cookies and similar technologies (see clause 8);

(e) Advertising and analytics identifiers — cookie identifiers, Google Ads click identifiers (such as GCLID), and analytics identifiers associated with your browser or device; and

(f) Feedback and correspondence — any feedback, review, complaint, or other correspondence you send us, including privacy and access requests.

3.2 Sensitive information. We do not seek to collect sensitive information (such as health information, racial or ethnic origin, religious beliefs, or criminal record) and ask that you do not include it in an Enquiry. If you include sensitive information in a free-text field or telephone call, you consent to us handling it as part of your Enquiry in accordance with this Policy, including its transmission to Providers, and we will otherwise handle it only as permitted by the Privacy Act.

3.3 Government identifiers. We do not collect, use, or disclose government-related identifiers (such as tax file numbers, Medicare numbers, or driver licence numbers) and ask that you do not provide them.

3.4 Children. The Website is directed at adults with legal capacity to contract for concreting services. We do not knowingly collect Personal Information from persons under 18. If you believe a person under 18 has submitted an Enquiry, please contact us using the details in clause 20 and we will take reasonable steps to delete the information.

4. How we collect Personal Information

4.1 We collect Personal Information:

(a) Directly from you — when you submit a web form, call a telephone number displayed on the Website, send an SMS or email, use any live chat facility, respond to our follow-up communications, or otherwise correspond with us;

(b) Automatically — through cookies, analytics tools, advertising conversion tracking, call-tracking systems, and server logs, when you visit and interact with the Website; and

(c) From third parties in limited circumstances — for example, from a Provider confirming the outcome of a referral (such as whether you were contacted, quoted, or engaged), from advertising platforms reporting on the source of your visit, or from a person authorised to act on your behalf.

4.2 Collection by lawful and fair means. We collect Personal Information only by lawful and fair means, and only where it is reasonably necessary for one or more of the functions or activities described in this Policy.

4.3 Unsolicited information. If we receive Personal Information we did not solicit and determine we could not have collected it under the APPs, we will destroy or de-identify it as soon as practicable, if it is lawful and reasonable to do so.

4.4 Anonymity and pseudonymity. You may browse the Website without identifying yourself. However, it is not practicable for us to provide the Referral Service anonymously or pseudonymously, because Providers require genuine contact details in order to respond to your Enquiry. If you submit an Enquiry, you must provide accurate contact details.

5. Why we collect, hold, and use Personal Information

5.1 We collect, hold, and use Personal Information for the following purposes:

(a) Providing the Referral Service — receiving your Enquiry, verifying that it appears genuine, and transmitting it to one or more Providers so they can contact you (this is the primary purpose of collection);

(b) Communicating with you — contacting you by telephone, SMS, or email in connection with your Enquiry, including to confirm receipt, clarify project details, notify you that your Enquiry has been referred, or follow up on the outcome;

(c) Managing our commercial arrangements with Providers — recording which Enquiries were referred to which Providers, verifying lead volume and quality, resolving billing or lead-validity disputes with Providers, and administering our fee arrangements;

(d) Operating, securing, and improving the Website — monitoring performance, diagnosing faults, preventing and investigating fraud, spam, click fraud, scraping, and other misuse, and improving content, layout, and user experience;

(e) Advertising and measurement — measuring the effectiveness of our advertising (including Google Ads conversion tracking), attributing Enquiries to advertising sources, and managing advertising spend;

(f) Direct marketing in limited circumstances — as described in clause 9;

(g) Complaints, disputes, and legal compliance — handling complaints and access or correction requests, resolving disputes, establishing or defending legal claims, and complying with our legal obligations, including under the Privacy Act, the Spam Act 2003 (Cth), the Do Not Call Register Act 2006 (Cth), and applicable consumer and telecommunications law; and

(h) Related purposes you would reasonably expect, or otherwise with your consent or as permitted or required by law.

5.2 If we do not collect the Personal Information described in this Policy, we may be unable to provide the Referral Service, respond to your Enquiry, or refer you to any Provider.

6. Disclosure of Personal Information

6.1 We may disclose Personal Information to:

(a) Providers — as described in clause 2, being the central purpose of the Website. The information disclosed will generally comprise your name, contact details, suburb or project address, and the project details you supplied. Your Enquiry may be disclosed to a single Provider or to more than one Provider, and you may therefore be contacted by more than one business;

(b) Service providers and contractors who support the operation of the Website and the Referral Service, including web hosting and site-building platforms, domain registrars, form-handling and email delivery services, SMS gateways, call-tracking and telephony providers, analytics providers, advertising platforms, CRM or spreadsheet tools used to manage Enquiries, IT support, and professional advisers (such as accountants and lawyers), in each case only to the extent reasonably necessary for them to provide their services to us;

(c) Regulators, law enforcement, courts, and government bodies — where required or authorised by law, including in response to a subpoena, warrant, notice, or statutory request, or where reasonably necessary for enforcement-related activities;

(d) Parties to a business transaction — if we sell, lease, assign, or otherwise transfer the Website or our business (or negotiate to do so), Personal Information may be disclosed to the prospective or actual purchaser, lessee, or assignee and their advisers, subject to appropriate confidentiality obligations, and any successor will be required to handle it consistently with this Policy; and

(e) Other persons with your consent or as otherwise permitted by the Privacy Act.

6.2 We do not sell Personal Information to unrelated data brokers or list marketers. Disclosure of Enquiry information is limited to the Providers and service providers described above.

7. Telephone calls, call tracking, and call recording

7.1 Telephone numbers displayed on the Website may be call-tracking numbers operated by third-party telephony services. When you call such a number, the call is routed to us or to a Provider, and the telephony service collects call metadata (including your phone number, and the time, duration, and source of the call) for attribution and billing purposes.

7.2 Calls made to or from numbers associated with the Website may be recorded or logged for verification, quality, dispute-resolution, and training purposes. Where a call is recorded, this will be disclosed at the start of the call where required by law, including the Surveillance Devices Act 1999 (Vic) and equivalent legislation in other States and Territories. If you do not wish to be recorded, you may say so at the start of the call or contact us in writing instead.

7.3 Some communications may be initiated or assisted by automated systems (for example, automated SMS notifications or call-routing). Where any automated or AI-assisted voice system is used on a call, this will be disclosed at the start of the call in accordance with applicable law and industry standards, including the ACMA telemarketing industry standards.

7.4 Do Not Call Register. By submitting an Enquiry you expressly consent to being contacted by us and by the Provider(s) to whom your Enquiry is referred, by telephone, SMS, and email, in connection with your Enquiry — including where your number is listed on the Do Not Call Register — on the basis that your Enquiry constitutes consent for the purposes of the Do Not Call Register Act 2006 (Cth) and the Spam Act 2003 (Cth). This consent is limited to communications reasonably connected to your Enquiry and may be withdrawn at any time using the contact details in clause 20.

8. Cookies, analytics, and online advertising

8.1 The Website uses cookies and similar technologies (such as pixels, tags, and local storage) to operate, analyse, and advertise the Website. These include:

(a) Strictly necessary cookies — required for the Website and its forms to function;

(b) Analytics cookies — such as Google Analytics, which collect information about how visitors use the Website (pages viewed, time on site, approximate location, device and browser information) to help us understand and improve performance. Analytics data is collected in a form that does not directly identify you to us, although it may constitute Personal Information in some circumstances; and

(c) Advertising cookies and conversion tracking — such as Google Ads conversion tracking, which records that a visitor who clicked one of our advertisements went on to submit an Enquiry or call a tracked number, so we can measure advertising effectiveness. This may involve identifiers such as the Google click ID (GCLID) being associated with your Enquiry.

8.2 Third-party providers of these technologies (including Google) may collect and process information in accordance with their own privacy policies. You can learn about how Google uses data at Google's privacy and partner-sites documentation, opt out of Google Analytics using the Google Analytics opt-out browser add-on, and manage ad personalisation through Google's Ads Settings.

8.3 You can control or delete cookies through your browser settings and can generally set your browser to refuse cookies. If you do, some features of the Website (including forms and conversion measurement) may not function correctly.

8.4 The Website does not currently respond to "Do Not Track" browser signals.

9. Direct marketing

9.1 We may use your contact details to send you communications directly connected to your Enquiry (for example, confirming your Enquiry was referred, checking whether you were contacted, or asking about your experience). You would reasonably expect these communications, and they are the primary way the Referral Service is administered.

9.2 We will only send you marketing communications unrelated to your Enquiry where permitted by the Spam Act 2003 (Cth) and the Privacy Act. Any commercial electronic message we send will identify us as the sender and contain a functional unsubscribe facility.

9.3 You may opt out of marketing communications at any time by using the unsubscribe facility in the message or by contacting us using the details in clause 20. We will give effect to an opt-out request within a reasonable period and will not charge you for doing so.

9.4 We do not disclose your Personal Information to third parties for their direct marketing purposes unrelated to your Enquiry. Disclosure to Providers is for the purpose of responding to your Enquiry, not general marketing; however, a Provider's own subsequent marketing to you is governed by that Provider's practices and applicable law, and any opt-out should be directed to that Provider.

10. Cross-border disclosure of Personal Information

10.1 Some of the service providers we use to operate the Website — including website hosting and site-building platforms, form-handling services, email delivery services, analytics providers, and advertising platforms — are located, or store or process data, outside Australia, including in the United States and in other jurisdictions in which those providers or their infrastructure operate (which may include the European Union, the United Kingdom, and Singapore).

10.2 This means that Personal Information you submit through the Website may be transferred to, stored in, or accessed from those overseas locations for the purposes described in this Policy.

10.3 Where we disclose Personal Information to an overseas recipient, we take reasonable steps to ensure the recipient handles it consistently with the APPs, such as by using reputable providers that offer contractual privacy and security commitments. By submitting an Enquiry or using the Website, you consent to the cross-border disclosure of your Personal Information as described in this clause, and you acknowledge that overseas recipients may be subject to foreign laws and that APP 8.1 will not apply to disclosures made with your consent under APP 8.2(b).

10.4 The Providers to whom your Enquiry is referred are located in Australia.

11. How we hold and secure Personal Information

11.1 Personal Information may be held in electronic form in systems operated by us and by our service providers, including form-handling and email systems, telephony and call-tracking platforms, analytics and advertising platforms, and business records (such as spreadsheets or CRM tools used to log Enquiries and referrals).

11.2 We take reasonable steps to protect Personal Information from misuse, interference, and loss, and from unauthorised access, modification, and disclosure. These steps include: using reputable service providers; enabling encryption in transit (TLS/HTTPS) for the Website and forms; restricting access to Enquiry data to those who need it; using access controls, strong passwords, and multi-factor authentication on key accounts; and reviewing what data we retain.

11.3 No method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. Transmission of information to and from the Website is at your own risk to the extent permitted by law.

11.4 Notifiable data breaches. If a data breach occurs that is likely to result in serious harm to any individual, we will comply with the Notifiable Data Breaches scheme in Part IIIC of the Privacy Act, including notifying affected individuals and the Office of the Australian Information Commissioner ("OAIC") where required.

12. Retention, destruction, and de-identification

12.1 We retain Personal Information only for as long as it is reasonably necessary for the purposes described in this Policy, including: administering the Referral Service; verifying and reconciling lead fees with Providers; handling complaints and disputes; maintaining business and tax records; and complying with legal obligations (which may require retention for several years).

12.2 When Personal Information is no longer needed for any purpose for which it may be used or disclosed under the APPs, and we are not required by law to retain it, we take reasonable steps to destroy it or ensure it is de-identified.

12.3 Call recordings, where made, are retained only for as long as reasonably necessary for the verification, quality, and dispute-resolution purposes described in clause 7.

13. Quality of Personal Information

13.1 We take reasonable steps to ensure the Personal Information we collect, use, and disclose is accurate, up to date, complete, and — in the case of use and disclosure — relevant. The accuracy of your Enquiry depends substantially on the information you provide, and you warrant under the Terms of Service that it is true, accurate, complete, and your own.

13.2 Please contact us using the details in clause 20 if any information you have provided changes or you believe information we hold about you is inaccurate.

14. Access to your Personal Information

14.1 You may request access to the Personal Information we hold about you at any time by contacting us using the details in clause 20. We may need to verify your identity before providing access.

14.2 We will respond to an access request within a reasonable period (generally within 30 days) and will provide access in the manner you request where it is reasonable and practicable to do so. We do not charge for making a request. If a charge applies for giving access (for example, for substantial retrieval effort), it will not be excessive and we will tell you the likely charge before proceeding.

14.3 In limited circumstances permitted by the Privacy Act we may refuse access in whole or in part (for example, where access would unreasonably impact another person's privacy, would prejudice legal proceedings, or is frivolous or vexatious). If we refuse access, we will give you written reasons (except where it would be unreasonable to do so), refer to the relevant provisions of the Privacy Act, and explain how you may complain about the refusal.

15. Correction of your Personal Information

15.1 If you believe Personal Information we hold about you is inaccurate, out of date, incomplete, irrelevant, or misleading, you may ask us to correct it using the contact details in clause 20, and we will take reasonable steps to do so.

15.2 If we have disclosed the relevant information to a Provider or other third party and you ask us to notify them of the correction, we will take reasonable steps to do so unless it is impracticable or unlawful.

15.3 If we refuse a correction request, we will give you written reasons, explain how you may complain, and — if you request — take reasonable steps to associate a statement with the information noting that you consider it inaccurate, out of date, incomplete, irrelevant, or misleading.

16. Requesting deletion or withdrawal of consent

16.1 You may at any time ask us to stop contacting you, stop referring your Enquiry, or delete the Personal Information we hold about you, using the contact details in clause 20. We will action such requests within a reasonable period, subject to any information we are required or entitled to retain by law (for example, for tax, dispute, or record-keeping purposes).

16.2 If your Enquiry has already been transmitted to one or more Providers before we receive your request, we cannot recall it. We will, on request, tell you which Provider(s) received your Enquiry so you can contact them directly, and we will take reasonable steps to pass your request on to them.

17. Third-party websites and services

17.1 The Website may contain links to external websites, and the Referral Service depends on third-party platforms as described in this Policy. This Policy applies only to our handling of Personal Information. We are not responsible for the privacy practices of any third party, including Providers, and we encourage you to review the privacy policies of any third party whose website or services you use.

18. Making a privacy complaint

18.1 If you believe we have breached the Privacy Act, the APPs, or this Policy, or you have any privacy concern, please contact us first using the details in clause 20, marking your communication "Privacy Complaint" and including enough detail for us to investigate.

18.2 We will acknowledge your complaint within a reasonable period (generally within 7 days), investigate it, and aim to provide a substantive response within 30 days. We may ask you for further information and will handle your complaint in good faith and free of charge.

18.3 If you are not satisfied with our response, or we do not respond within a reasonable time, you may complain to the Office of the Australian Information Commissioner:

18.4 Nothing in this Policy limits your right to complain to the OAIC or any other regulator at any time.

19. Changes to this Privacy Policy

19.1 We may amend this Privacy Policy from time to time by publishing the amended version on the Website with an updated "Last updated" date. The version published at the time of your use of the Website applies to that use. Material changes to how we handle Personal Information will apply prospectively.
